Welcome to RecipeScan! These Terms of Use ("Terms") govern your access to and use of the RecipeScan mobile application ("App") provided by RecipeScan ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

Please read these Terms carefully before using the App. If you do not agree to these Terms, you may not access or use the App.

1. Acceptance of Terms

By creating an account or using the App, you confirm that:

  • You are at least 13 years of age (or the minimum age required in your jurisdiction)
  • You have the legal capacity to enter into a binding agreement
  • You will comply with these Terms and all applicable laws and regulations

2. Description of Service

RecipeScan is an AI-powered cooking and meal planning application that provides:

  • Ingredient scanning and recognition
  • Pantry scanning via camera to identify and inventory food items
  • AI-powered grocery list generation based on recipes and pantry contents
  • Personalized recipe recommendations
  • AI-generated recipes based on available ingredients
  • Meal planning and grocery list features
  • Nutrition and budget tracking
  • Voice-controlled cooking assistance
  • Recipe import from social media platforms

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You may sign up using:

  • Sign in with Apple
  • Email and password
  • Guest mode (limited features)

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

3.3 Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payments

4.1 Free and Premium Tiers

RecipeScan offers both free and premium subscription options:

  • Free Tier: Browse 800+ recipes, save unlimited favorites, basic meal planning, grocery lists, and try AI scanning and recipe generation.
  • Premium Subscription: Unlimited access to all features including unlimited Pantry Scan, unlimited AI ingredient scanning, unlimited AI recipe generation, AI-powered grocery lists, voice-guided cooking mode, advanced nutrition tracking, family sharing, and priority support. Offered as monthly ($4.99/month) or annual ($29.99/year) subscriptions. A 7-day free trial is included with new subscriptions.

4.2 Billing

Premium subscriptions are billed through Apple's App Store. By subscribing, you agree to:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscription automatically renews unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your Apple ID Account Settings

4.3 Refunds

Refunds are handled by Apple in accordance with their refund policies. We do not process refunds directly. To request a refund, please contact Apple Support or use the "Report a Problem" feature in your purchase history.

4.4 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle after the change is announced.

5. User Content

5.1 Your Content

You retain ownership of content you create or upload to the App, including:

  • Custom recipes
  • Meal plans
  • Notes and modifications
  • Photos you upload

5.2 License Grant

By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the App's services.

5.3 Content Guidelines

You agree not to upload content that:

  • Infringes on intellectual property rights
  • Contains harmful, offensive, or illegal material
  • Violates any applicable laws or regulations
  • Contains malware or harmful code

6. Intellectual Property

6.1 Our Content

The App, including its design, features, code, graphics, and content (excluding user-generated content), is owned by RecipeScan and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or decompile the App
  • Remove any copyright or proprietary notices
  • Use our trademarks without permission

6.2 Third-Party Content

The App may display recipes and content from third-party sources (YouTube, TikTok, Instagram). This content remains the property of its respective owners and is subject to their terms of use.

7. AI-Generated Content

7.1 Nature of AI Recipes

Recipes generated by our AI are provided for informational and entertainment purposes. While we strive for accuracy, AI-generated recipes:

  • May not account for all dietary restrictions or allergies
  • Should be reviewed before preparation
  • May require adjustments based on your preferences and available ingredients

7.2 No Professional Advice

RecipeScan does not provide medical, nutritional, or professional culinary advice. Always consult appropriate professionals for dietary restrictions, allergies, or health-related concerns.

8. Health and Safety Disclaimers

8.1 Allergies and Dietary Restrictions

While RecipeScan allows you to specify dietary restrictions and allergies, we cannot guarantee that all recipes will be suitable for your specific needs. You are responsible for:

  • Verifying ingredients for potential allergens
  • Consulting with healthcare providers about dietary requirements
  • Making informed decisions about what you consume

8.2 Food Safety

You are responsible for following proper food safety practices, including safe handling, storage, and cooking temperatures. RecipeScan is not liable for any foodborne illness or injury resulting from recipe preparation.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS

10. Indemnification

You agree to indemnify and hold harmless RecipeScan and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload to the App

11. Third-Party Services

The App may integrate with or link to third-party services. We are not responsible for:

  • The availability or content of third-party services
  • Any transactions between you and third parties
  • Privacy practices of third-party services

Your use of third-party services is subject to their respective terms and privacy policies.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date
  • Sending a notification for significant changes

Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the App ceases immediately
  • We may delete your account and data
  • Provisions that should survive termination will remain in effect

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in California.

15. Dispute Resolution

Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting us at legal@recipescannerapp.com. We will attempt to resolve disputes within 30 days.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RecipeScan regarding the App and supersede all prior agreements.
